Information for Pet Owners

 

Pets are a wonderful addition to a family. Spring Mills is a pet friendly community, but there are some rules and regulations that pet owners should be aware of:

-Only common domestic house pets shall be allowed on any Unit or their improvements thereon, provided they are not kept or bred for any commercial purpose.

-Pets shall not be allowed to roam at large.

-Pets shall not be housed, fenced or otherwise maintained on a regular basis outside of the primary dwelling unit on any Unit.

-Kennels, dog runs, dog houses and other similar pet facilities are prohibited.

-No farm animals, livestock, or poultry of any kind shall be kept, maintained or in any way allowed on any Unit.

-The Unit Owners Association shall have absolute authority to prohibit unusual or exotic animals, birds or reptiles from being kept on any Unit or in an improvement located thereon.

-The Unit Owners Association shall have the authority to prohibit or regulate loud and noisy pets.

PLEASE clean up after your pet immediately, especially if it relieves itself on another resident's property. Try to get your pet to relieve itself on YOUR property before walking it through the rest of the neighborhood.

If you see someone's pet running loose in the neighborhood, please report it to the owner (if known), or to the Board of Directors to take needed action.

 

Please note: It is ILLEGAL in West Virginia to poison, kill, or otherwise harm a dog or cat. If you poison or otherwise harm another resident's pet, even if that pet was running loose, you are subject to prosecution under West Virginia law:

ARTICLE 20. DOGS AND CATS.

s 19-20-12 Dogs, other animals and reptiles protected by law; unlawful killing thereof; aggrieved owner's remedy; penalties; penalties for unlawful stealing of pets.

(a) Any dog which is registered, kept and controlled as provided in this article or any dog, cat, other animal or any reptile which is owned, kept and maintained as a pet by any person, irrespective of age, shall be protected by law; and any person who shall intentionally and unlawfully kill, injure or poison any such dog, cat, other animal or any reptile as specified above, or shall, in any other manner, intentionally and unlawfully cause the death or injury of any such dog, cat, other animal or any reptile shall be guilty of a misdemeanor, and, upon conviction thereof, shall be ordered to provide public service for not less than thirty nor more than ninety days, or fined not more than three hundred dollars, or both. Any person whose dog, cat, other animal or reptile as specified herein shall be killed or injured wrongfully or unlawfully by any other person shall have a right of action against the person who shall so kill or injure such dog, cat, animal or reptile but in no case involving a dog can recovery be had in excess of the assessed value of such dog.
